1. Introduction and Acceptance

RecruitMatch AI is a platform operated by Digital Rebel BV, a private limited liability company incorporated under the laws of the Netherlands. RecruitMatch AI is a trade name of Digital Rebel BV.

By accessing or using RecruitMatch AI via https://recruitmatch.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms should be read together with our Privacy Policy, which forms an integral part of this agreement.

2. Description of the Service

RecruitMatch AI provides software tools for candidates and recruiters, including but not limited to:

• Resume and CV analysis
• ATS compatibility checks and match scoring
• Resume and cover letter generation
• Candidate-to-job matching and ranking
• Candidate data management for recruiters

The Service provides decision support only. RecruitMatch AI does not make hiring decisions, employment offers, or guarantees of outcomes.

We may update, modify, suspend, or discontinue parts of the Service at any time.

3. Eligibility and User Accounts

3.1 Age Requirement

You must be at least 16 years old to use the Service. By creating an account, you confirm that you meet this requirement.

3.2 Account Registration

You agree to:

• Provide accurate and complete registration information
• Keep your login credentials confidential
• Be responsible for all activity under your account
• Notify us immediately of unauthorized use

You are responsible for ensuring that your use of the Service complies with applicable laws.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful or misleading purposes
• Upload false, misleading, or unauthorized content
• Upload personal data without a lawful basis or consent
• Attempt to bypass security or access controls
• Scrape, copy, or extract data without permission
• Resell, sublicense, or commercially exploit the Service without written consent

We reserve the right to investigate and take appropriate action for violations.

5. User Content and License

5.1 Ownership

You retain ownership of all content you upload, including resumes, cover letters, and candidate data.

5.2 License to Process

By using the Service, you grant Digital Rebel BV a limited, non-exclusive license to process your content solely for the purpose of providing the Service, including analysis, matching, storage, and optimization.

We do not use uploaded content for advertising or resale.

6. Recruiter-Specific Terms

If you use RecruitMatch AI as a recruiter:

• You are the data controller for candidate data you upload
• You confirm that you have obtained all necessary consents
• You agree to comply with GDPR and applicable employment laws
• RecruitMatch AI acts as a data processor on your behalf

By uploading candidate data, you agree to our Data Processing Addendum (DPA).

7. AI Usage Disclaimer

RecruitMatch AI uses artificial intelligence to generate scores, suggestions, and insights.

You acknowledge that:

• AI outputs are informational only
• Results may contain inaccuracies
• Final decisions remain your responsibility
• No automated decisions with legal or significant effects are made

RecruitMatch AI does not guarantee interview success, hiring outcomes, or job placement.

8. Payments and Subscriptions

• Paid plans are billed in advance on a recurring basis
• Prices are shown excluding VAT unless stated otherwise
• Subscriptions can be cancelled at any time
• Access remains active until the end of the billing period
• Refunds are discretionary unless required by law

Failure to pay may result in suspension or termination of access.

9. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Misuse the Service
• Upload unlawful content
• Create security or legal risk

Upon termination:

• Your access ends immediately
• Data handling follows our Privacy Policy

You may terminate your account at any time via account settings.

10. Intellectual Property

All platform software, branding, and proprietary technology are owned by Digital Rebel BV.

You may not:

• Copy or reverse engineer the Service
• Use our trademarks without permission
• Remove legal notices

11. Limitation of Liability

To the maximum extent permitted by law:

• Digital Rebel BV is not liable for indirect or consequential damages
• We are not liable for loss of data, revenue, or opportunities
• Total liability is limited to the amount paid by you in the preceding 12 months

Nothing in these Terms limits liability where such limitation is prohibited by law.

12. Indemnification

You agree to indemnify and hold harmless Digital Rebel BV from claims arising from:

• Your use of the Service
• Content you upload
• Violation of laws or third-party rights

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands.

Any disputes shall be submitted exclusively to the competent courts in the Netherlands.
